Judge grants breakaway parties’ motion

On Wednesday, June 10, 2015, the Hon. John P. Chupp granted the Third Motion for Partial Summary Judgment (All Saints’) of the defendant breakaway ACNA parties and denied the Supplemental Motion for Partial Summary Judgment (All Saints’) of the plaintiff Episcopal Parties. In the next few days the parties will confer on a final judgment to be signed by the judge, to include the rulings on March 2 and June 10. The entry of that judgment will set the stage for appeals by the plaintiff Episcopal Parties to the Fort Worth Court of Appeals, Texas Supreme Court, and the U.S. Supreme Court, if necessary.

Bishop Rayford B. High, Jr. , said, “I was present this morning at the hearing in Judge Chupp’s court for the Partial Summary Judgment. I believe our legal team did a very good job of presenting our case. I am disappointed in the decision but I know this will be appealed. This decision will not deter us from continuing to do the good work of the Gospel in our diocese, with determination and a good, loving, embracing spirit that has been our mark of faith.”

Judge Chupp had severed All Saints’ into a separate case because of differences in the facts, hence the two decisions of March 2 and June 10.
